Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Tech Neck ("we", "us", "our") governing your access to and use of the Tech Neck mobile application, any associated services, and this website (together, the "Service"). By downloading, installing, signing in to or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Plain-English summary. Tech Neck is a calm tilt reminder. It reads your phone's tilt angle and dims the screen when you slouch over it. It is not a medical device, not a diagnostic tool, and not a substitute for professional advice. Use it as a gentle nudge, not as treatment.

1. Who can use Tech Neck

You must be at least 18 years old, or the age of majority in your jurisdiction, to create a Tech Neck account and hold a subscription. Tech Neck is designed as a parental tool: a parent or guardian installs the app and holds the account; the child or other household member simply uses the device the app is installed on. By creating an account, you confirm you are the account holder and that any minor using the device is doing so with your permission and under your supervision.

2. Your account

Tech Neck uses Google Sign-In for account creation. You are responsible for safeguarding your Google credentials, your Tech Neck PIN, and any device the Service is installed on. You agree to notify us promptly if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.

3. Subscriptions, billing and free trial

Tech Neck is offered on a subscription basis through Google Play Billing. Current pricing is displayed in the app and on this website, and may include a 3-day free trial. Eligible plans are billed monthly or annually, and unless you cancel before the end of the current period your subscription will automatically renew at the then-current price. Taxes may apply.

Cancellation and refunds. You can cancel your subscription at any time through your Google Play account. Access to paid features continues until the end of the billing period you have already paid for. Refunds are handled according to the Google Play refund policy and any non-waivable rights you have under applicable law.

We use RevenueCat to verify subscription status. Payment details are handled by Google Play and are never seen or stored by us.

4. License to use the Service

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Tech Neck on devices that you own or control, for your own personal, non-commercial use.

5. Acceptable use

You agree not to:

  • reverse engineer, decompile, disassemble or attempt to derive the source code of the Service, except as expressly permitted by law;
  • copy, modify, distribute, sell or lease any part of the Service, or create derivative works based on it;
  • bypass, disable, interfere with or circumvent the PIN, parental controls, brightness logic or any other security feature;
  • use the Service in any way that could damage, disable, overburden or impair it, or interfere with any other user's use;
  • use the Service to harass, intimidate or surveil any person, including any child or household member;
  • use the Service in violation of any applicable law, regulation or third-party right.

6. Intellectual property

The Service, including the Tech Neck name, logo, illustrations, user interface, copy and underlying software, is owned by us or our licensors and is protected by copyright, trade mark and other laws. These Terms do not transfer any ownership to you. All rights not expressly granted are reserved.

7. Feedback

If you send us suggestions, ideas or feedback about the Service, you grant us a non-exclusive, perpetual, irrevocable, royalty-free licence to use and act on that feedback without any obligation to you.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes what we collect, what we don't, and how we handle your information.

9. Third-party services

The Service relies on third-party platforms, including Google Sign-In, Firebase, RevenueCat and Google Play Billing. Your use of those platforms is subject to their own terms and privacy policies. We are not responsible for the availability, accuracy or practices of any third-party service.

10. Not medical advice

Tech Neck is a behavioural reminder that adjusts your phone's screen brightness based on its tilt angle. It is not a medical device, and the Service does not diagnose, treat, cure, mitigate or prevent any disease or condition. Information presented in the Service — including posture scores, tilt angles and weekly summaries — is provided for general informational purposes only and is not a substitute for professional medical, ergonomic or health advice. If you have concerns about posture, neck pain, eye strain or screen use, consult a qualified healthcare professional. Do not rely on Tech Neck for any urgent or clinical need.

11. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability or error-free operation. We do not warrant that the Service will be compatible with every device or Android version, that brightness changes will be instantaneous, or that habits will improve as a result of using the Service. Nothing in these Terms is intended to exclude rights you have under applicable consumer-protection law that cannot be excluded.

12. Limitation of liability

To the maximum extent permitted by law, neither Tech Neck nor its owners, contractors or suppliers will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or anticipated savings, arising out of or in connection with your use of or inability to use the Service, whether based on contract, tort (including negligence), statute or any other legal theory, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for all claims relating to the Service is limited to the greater of (a) the amounts you paid to us for the Service in the twelve months preceding the claim, or (b) USD 50.

13. Indemnity

You agree to indemnify and hold Tech Neck and its owners harmless from any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to (a) your use or misuse of the Service, (b) your violation of these Terms, or (c) your violation of any law or third-party right.

14. Termination

You may stop using the Service at any time by cancelling your subscription and uninstalling the app. We may suspend or terminate your access to the Service, in whole or in part, if we believe you have breached these Terms or if continued operation would expose us to legal or operational risk. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnity and Governing Law) will survive.

15. Changes to the Service or these Terms

We may update the Service and these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, provide in-app notice. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.

16. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the Tech Neck account holder resides, except where mandatory local consumer-protection law applies. You and Tech Neck agree to first try to resolve any dispute informally by contacting us at [email protected]. If we cannot resolve it within 30 days, either party may pursue the dispute in a court of competent jurisdiction, subject to any non-waivable rights you have to bring proceedings locally.

17. Google Play EULA

If you obtained Tech Neck through the Google Play Store, you also agree to the Google Play Terms of Service. In the event of any conflict between these Terms and Google's terms, Google's terms will govern to the extent required by Google.
